Terms of Service

This document is a plain-language draft. It describes how Tuzzle actually works today and will be refined with formal legal review before general availability. If anything is unclear, email [email protected].

These terms govern your use of Tuzzle. They are written to be readable, because terms you cannot understand protect no one. Using the service means you accept them.

1. Acceptance and eligibility

By creating an account or using Tuzzle, you agree to these terms. You must be at least 18 or the age of majority where you live. If you accept on behalf of an organisation, you confirm you have the authority to bind it, and "you" means that organisation.

2. The service

Tuzzle provides media upload, storage, on-the-fly transformation, and delivery over a global edge network, together with the dashboard, APIs, and SDKs around them. We improve the service continuously and may add, change, or retire features. If a change materially reduces what you are paying for, we will give you reasonable notice.

3. Your account

You are responsible for activity under your account, including activity through your API keys. Keep credentials and keys secret, scope keys to what they need, rotate anything you believe is exposed, and tell us promptly about any unauthorised use. Keep your account details accurate so we can reach you about billing and security.

4. Plans, trials, and billing

Tuzzle has a free plan and paid plans billed monthly in advance. Prices are published on the pricing page in US Dollars and, for Nigerian customers, in Naira via Paystack. Naira prices are set directly, not converted at checkout.

Usage above your plan's included limits is billed at the published overage rates. You can set hard caps in the dashboard to prevent overage charges entirely. Taxes are added where the law requires them. We will give you at least 30 days' notice before a price increase affects you.

5. Cancellation and refunds

You can cancel or downgrade at any time from the dashboard, with no penalty. You keep access until the end of the period you have paid for. Fees already paid are non-refundable except where the law says otherwise.

6. Your content and licence

You retain every right to the assets you upload. You grant Tuzzle the limited licence needed to host, cache, process, transform, and deliver them on your instructions. That licence ends when the content is deleted, subject to short-lived caches and backups. Tuzzle's software, websites, and branding remain our property.

7. Your end users and their data

If you build Tuzzle into a product, you are responsible for your relationship with your end users: telling them how their uploads are handled and having a lawful basis to process their data. For personal data inside those uploads, you are the controller and Tuzzle processes it on your instructions under the Data Processing Addendum.

8. Acceptable use

Use of Tuzzle is subject to the Acceptable Use Policy, which covers illegal content, other people's rights, abuse of the platform, and fair use of storage and bandwidth. The short version: deliver your product's media, do not hurt anyone, and do not break the service.

9. Copyright complaints

If you believe content delivered through Tuzzle infringes your copyright, email [email protected] with the asset URLs and the details of your claim. We review complaints promptly and remove or disable access to content where a claim is substantiated.

10. API and fair use

Published rate limits and plan quotas exist to keep the platform fast for everyone. Do not attempt to bypass them, for example by generating cache-busting transform variants. If your workload is unusual but legitimate, talk to us; there is usually a sensible plan.

11. Third-party services

Payment processors and other third-party services you use alongside Tuzzle are governed by their own terms, and we are not responsible for them.

12. Availability and changes

We aim to keep Tuzzle available continuously and schedule maintenance with notice where we can. The Scale plan includes a 99.9% uptime SLA; other plans are provided on a best-effort basis.

13. Suspension and termination

You can close your account at any time. We may suspend or terminate accounts that breach these terms, create legal exposure, or put the platform or other customers at risk. Unless the breach is severe, we will warn you and give you a chance to fix it first.

14. Disclaimers

Tuzzle is provided "as is" and "as available". To the maximum extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of liability

To the extent permitted by law, neither party is liable for indirect, incidental, or consequential damages, and Tuzzle's total liability under these terms is capped at the fees you paid us in the twelve months before the claim arose.

16. Indemnity

You will indemnify Tuzzle against third-party claims arising from your content, your products, or your breach of these terms.

17. Governing law and disputes

These terms are governed by the laws of the Federal Republic of Nigeria, and disputes belong to the courts of Lagos State. If consumer law where you live gives you protections that cannot be waived, those protections still apply.

18. Changes to these terms

We may update these terms as the product and the law evolve. For material changes we will give at least 30 days' notice in the app or by email. Continuing to use Tuzzle after a change takes effect means you accept it.

19. General

These terms, together with the policies they reference, are the entire agreement between us about the service. If a provision turns out to be unenforceable, the rest stand. You may not assign these terms without our consent; we may assign them as part of a merger or acquisition.
